Over the last few years, the legal framework that medical and hospital activities are bound to, has undergone significant changes, through major legislative projects and the development of jurisprudence in many fields related to health law. The reforms, which are implemented within a particularly difficult context, concern public healthcare facilities, private facilities (profit and non-profit institutions), community medicine and the medico-social sector. With this in mind, the Master 2 Droit de la santé (Health Law) Tours- Poitiers provides students with the legal tools, both theoretical (via academic studies) and practical (via conferences given by professionals and via traineeships), to manage these changes and trains students to become specialist lawyers, who are able to provide their knowledge and skills to health administrations, health establishments, health agencies, law firms specialized in health law and structures that are dedicated to settling medical accidents (ONIAM (the National Office for the Settlement of Medical Accidents), CRCI (the regional Commissions for Conciliation and Compensation)), insurance companies, etc.

As a result of the significant changes that health law has undergone in the last few years, the Master 2 Droit de la santé (Health Law) comprises the following objectives:

FOR LAWYERS AND POLITICAL SCIENTISTS:
- Prepare and present health law cases (medical law, hospital law, pharmaceutical law, health product law, etc.).
- Prepare and apply legislation specific to the field.
- Prevent and solve disputes by interpreting the law.
- Provide information and documented advice in the field of health law.
- Propose amicable or judicial solutions for disputes.
- Assess the amount for damage.
- Assist health establishments with their certification procedures.
- Observe business confidentiality.
- Draw up agreements (doctor-clinic agreements, insurance contracts, etc.).

Graduates with these skills may enter careers in the legal departments of bodies and establishments that are specialized in the health sector: French Ministry for Health, public hospitals, private clinics, insurance companies, mutual insurance companies, pharmaceutical laboratories, private hospital unions, the French Agency for Biomedicine, Regional Health Agencies, ONIAM (the National Office for the Settlement of Medical Accidents), CRCI (the regional Commissions for Conciliation and Compensation), the French National Blood Service, Haute Autorité de Santé (French National Health Authority), legal departments of professional bodies, law firms, consultancy firms, associations, etc.

These skills also enable students to prepare the selection exam for the Ecole des hautes études en santé publique (EHESP) (French School for Advanced Public Health Studies) and the Ecole nationale d'études supérieures de la sécurité sociale (EN3S) (French School for Advanced Social Welfare Studies).

FOR HEALTH SECTOR PROFESSIONALS:
These skills enable them to:
- understand the legal framework of their activity.
- contribute to the operations of health institutions (for example, commissions des relations avec les usagers (User-Relations and Quality Commissions).
- understand in full the dossiers concerning ordinal and expertise activities.
 
  • Contents or list of themes and subjects taught
The Master 2 Droit de la santé (Health Law) comprises the following themes:
- medical law: medical profession code of conduct and method of exercise, civil, criminal, insurance liabilities, compensation through the national solidarity fund.
- health establishment law: hospital organization, hospital activity regulation, liability.
- health product law: Health product definitions and statuses, health product marketing, health product distribution, health product financing, liability in the event of defective products.
- health policies and economics
- English for health
- compulsory professional traineeship for at least three months, end-of-traineeship report.
- a module introducing medicine/medical-related issues where healthcare professionals run conferences for the students and talk about real problems encountered whilst carrying out their medical activity and invite students to deal with these by applying existing laws (end-of-life care, ethical issues raised by medical practice).
- a module on presentations and miscellaneous work offering students the opportunity to undertake various exercises (presentations-discussions, conference organization; lecture note-taking, etc.) alone and in groups. This module helps them gain experience in practices that will become indispensible for them in their professional life: speaking in public, managing projects, group work, writing overviews, etc.
 
  • Prerequisites
The professional M2 Droit de la santé (Health Law) is open to:
- students who hold a 1st year of a Master in Law (the two M1 semesters must be validated): public law, private law, health and social law.
- students who have graduated from Institutes of Political Studies
- health professionals providing the fill certain prerequisites.

Students are selected for the M2 on application dossier followed by an interview.
